Wills and Probate Wills A Will is one of the most important documents you will ever make yet many fail to do so. Your Will forms part of your financial planning and should therefore be reviewed and updated every few years. By not making a Will your spouse, children and partner could lose out. At Philip Avery & Co. we can ensure your wishes are recorded in your Will and your assets are left to those persons closest to you. A simple Will can cost as little as £80 plus VAT. The Court protects the interests and affairs of someone who has lost mental capacity, such as where someone has advanced Alzheimers or Senile Dementia, by appointing someone, usually a member of the family, to deal with and handle that person’s affairs. Our solicitors can make the necessary contact and implement the required procedure with the Court on your behalf.
A general power of attorney is often used when a person is abroad and requires an attorney to sign documents on his/her behalf. An enduring power of attorney is more commonly used when a person is elderly and is concerned about their future ability to manage their affairs. The attorney can then deal with your affairs should you wish him/her to do so. We can of course draft the necessary documents on your behalf. Take note that enduring powers of attorney are being replaced in 2007 with Lasting Powers of Attorney.
Usually when a person has died then an application has to be made for a Grant of Probate at the Probate Registry in order the next of kin or executors in a Will can deal with the deceased’s affairs. A detailed Inland Revenue form also has to be completed for inheritance tax purposes to include the value of all the assets of the estate such as the house, shares, bank accounts, pensions, life insurance policies, funeral expenses etc. Obtaining Probate can involve the drafting of complex legal documents and our solicitors at Philip Avery & Co. can offer their expertise, draft and obtain the necessary legal documents on your behalf and assist in the completion of the Inland Revenue form.
When a person has passed away then someone, usually an executor in a Will or next of kin, will have to deal with the deceased’s personal property, including a house, shares, bank accounts, pensions, life insurance policies, funeral expenses etc. Administering the estate can be timely and stressful and our solicitors at Philip Avery & Co. can take some of that stress by administering the estate on your behalf. Our solicitors fees are usually based on a
percentage of the estate, usually ½ (0.5) or ¾ (0.75)
